Employment Contract
534. SICK LEAVE
The Board ensures that support employees shall be granted sick leave according to the following definitions and guidelines.
Sick leave is leave taken by a regular, full-time employee of the school district who is absent from assigned duty because of personal disability due to illness or injury, a doctor’s appointment for the employee, or because s/he has been excluded from work as a result of contagious disease or other condition that creates a hazard for students and other employees. Part-time employees are not eligible for sick leave. Sick leave may not be used as emergency or personal leave. Sick leave may only be used for the illness of the employee.
Sick leave shall be cumulative from year to year without limitation. Full-time support employees shall be entitled to one (1) day of sick leave per month as follows:
12-month employees - 12 days sick leave per year
11-month employees - 11 days sick leave per year
Student Year employees - 9 days sick leave per year
Employees may be required, at the discretion of their immediate or district level supervisor, to present a physician's certificate stating the reason for an absence.
Eligibility
Sick leave shall commence when the employee is sufficiently disabled and reports the absence. A sick leave day, once commenced, may be reinstated as a working day only with the approval of the Superintendent or designee.
Whatever the claim of disability, no day of absence shall be considered to be a sick leave day on which the employee has engaged in or prepared for other gainful employment, has participated in a work stoppage, or has engaged in any activity that would raise doubts regarding the validity of the sick leave request.
Proof of Disability
Any employee absent on sick leave may be required to submit a physician’s written statement certifying his/her disability, and every employee absent for five (5) or more consecutive sick leave days shall be required to submit such a statement. Such statements may not be presumed to establish conclusively the employee’s disability.
Duration of Leave
Upon the expiration of all currently earned and accumulated sick leave and, if a member, expiration of sick leave days granted through the Sick Leave Bank, an employee may request that the Board grant uncompensated leave.
Requests for uncompensated leave shall be considered under the terms of existing policy regulating uncompensated leave.
Records
The personnel records of the district shall show the attendance of each employee, and such days, as that employee may be absent for sick leave purposes shall be recorded with the reason for such absence noted. A record shall be made annually of the unused sick leave days accumulated by each employee, and shall be reported to the employee.
Family Leave
Employees shall be eligible to convert sick leave days in any school year for use as family leave days. No more than two (2) family leave days can be used in any school year.
Family leave days shall be used only in instances when an immediate family member is ill and needs support to obtain medical treatment outside the home or requires the presence of the employee. Immediate family includes only spouse, son, daughter, stepson, stepdaughter, mother and father of the employee.
Family leave does not authorize the employee to attend to personal business or engage in personal activities.
When using family leave, an employee must request that sick leave be converted to family leave and shall disclose, on a district form, the immediate family member involved and whether the employee transported the immediate family member to a medical appointment and/or provided care and comfort.
