524. PERSONNEL FILES

The Board recognizes that in order to provide for the orderly and efficient operation of the school district it is necessary to maintain a file for the retention of all papers bearing upon an individual's duties, responsibilities and performance as an employee of the district.

The Board requires that sufficient records be maintained to ensure an employee's qualifications for the job held, compliance with federal and state statutes, eligibility for local benefit programs, conformance with district rules, and evidence of completed evaluations.

The Board delegates the establishment and maintenance of official personnel records to the Superintendent.
Direct access to personnel files shall be limited to the Superintendent, Assistant Superintendent, and Executive Secretary to the Superintendent. Personnel records shall not be available to the Board or its individual members except as may be required in the performance of its functions as a Board in due process proceedings or similar formal procedures specifically approved by the Board.

A support employee may review the contents of his/her personnel file at any time during regular school hours, consistent with the provisions of the Personnel Files Act, 43 P.S. Section 1321 et seq. and any policies established by the Board relating to such inspection. S/He shall be given the opportunity to make copies of any document contained in such file, except as noted below in this paragraph. In examining his/her file, an employee shall be entitled to be accompanied by a representative of his/her choice. Each employee shall be promptly notified in writing of the placing of any document in his/her personnel file. All personnel files shall be kept in the central office of the district. College credentials and letters of reference from persons other than employees of the district or members of the Board shall be kept in a separate file and shall not be made available to the employee or representative without the consent of the Superintendent.

Medical records shall be kept in a file separate from the employee’s personnel file in compliance with current regulations.

Appeals

Personnel who choose to appeal material in their records shall make a written request to the Superintendent and shall specify:

1. Name and date.
2. Material to be appealed.
3. Reason for appeal.

The Superintendent shall hear the appeal and make a determination.

Title I Schools

In accordance with federal law, the district shall release to parents/guardians, upon request, information regarding the paraprofessional qualifications, certification, and academic degrees of any paraprofessional providing instruction to their child at a school receiving Title I funds. The district shall annually notify parents/guardians at the beginning of the school year about their right to request such information.
