Personal Necessity Leave
436. PERSONAL NECESSITY LEAVE
This policy shall provide for a professional employee's absence for personal necessity when not otherwise covered by sick leave or disability policies.
The Board has the authority to specify reasonable conditions under which personal leave may be granted, the type of situations in which such leave will be permitted and the total number of days that may be used in any school year for personal leave.
Personal Leave
The Board will grant to each teacher two (2) days of personal leave per contractual teaching school year without loss of pay. A limit of ten percent (10%) of the professional personnel assigned to a building and/or department shall be granted personal leave on any one day. Written notification to the building principal of use of such leave must be given at least twenty-four (24) hours in advance of planned leave and preferably five (5) teaching days prior to requested day of leave, unless it is of an emergency nature. Personal leave days shall not be granted on the first two (2) or last two (2) days of the teacher school year, but will be granted on the day immediately prior to or following a holiday or vacation provided a qualified substitute teacher can be secured as a replacement.A written request, using the appropriate district form, shall be submitted to the building principal.
Personal leave days shall be cumulative to five (5) days. Personal leave accumulated in excess of five (5) days shall be converted to sick leave.
Emergency Leave
The Board will grant to each teacher two (2) days of emergency leave during the regular school year, without loss of pay, in accordance with the present Board policy. Emergency leave is limited to include surgery or illness of an employee or an employee's immediate family member and other bona fide emergencies; such bona fide emergencies to be subject to the approval of the Superintendent or his/her designee. Illness of a dependent will be considered an emergency.
Bereavement Leave
Death of a member of the employee's immediate family shall not result in a deduction of salary for absence not in excess of three (3) school days.Immediate family, as defined in the School Code, shall be limited to father, mother, brother, sister, son, daughter, husband, wife, parent-in-law, or near relative who resides in the same household or any person with whom the employee has made his/her home.Death of an employee's near relative shall not result in a deduction in salary for absence on the day of the funeral.Near relative, as defined in the School Code, shall be limited to first cousin, grandfather, grandmother, aunt, uncle, niece, nephew, son-in-law, daughter-in-law, brother-in-law, or sister-in-law.
