Use of Tobacco Products
707.1. USE OF TOBACCO PRODUCTS
The Board recognizes that the use of tobacco is detrimental to the health of users and non-user, can be a safety hazard for the District's facilities, and is prohibited, on or in school premises, by law. To protect students and District employees from the harmful effects of tobacco and to protect the District's facilities from the possible fire hazards associated with smoking tobacco, the Board prohibits the use of tobacco on school premises. District employees and school visitors are forbidden from using tobacco on school premises.
As used in this policy, the following terms shall have the meaning stated below:
1. Tobacco - means a lighted or unlighted cigarette, pipe or other lighted smoking product, and smokeless tobacco in any form, including chewing tobacco and snuff.
2. Smoking - means the carrying by a person of a lighted cigar, cigarette, pipe, or other lighted smoking device.
3. School premises - shall mean all school buildings, school grounds, school owned or leased buses or vehicles, and all school sponsored activities regardless of location.
4. Visitor – Any person other than school district employee or student.
Incidents of use or sale of tobacco by any person on school property shall be reported to the Office of Safe Schools on the required form at least once each year.
Any visitor found to be smoking on school premises may be subject to a $50.00 civil fine imposed by the Pennsylvania Department of Labor and Industry and criminal prosecution under the Fire and Panic Act, Section 1230.1, 1233, and 1235. In addition, any school visitor who violates this policy may be excluded from school premises.
